1. Introduction
Welcome to VedicMap, operated by AyurvedaNest.org (hereinafter referred to as "we", "us", "our", or "VedicMap"). These Terms and Conditions govern your access to and use of the VedicMap website and application (collectively, the "Platform"), including all content, functionality, services, and subscription offerings provided on or through the Platform.
By accessing, registering for, or using the Platform, you accept and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.
2. About Our Services
VedicMap provides personalized Vedic astrology services, including birth chart calculations, Dasha (planetary period) analysis, compatibility reports, transit forecasts, yoga detection, Ashtakavarga analysis, and subscription-based access to our astrology application featuring personalized predictions, remedies, and guidance based on Vedic astrological principles.
3. Eligibility
You must be at least 18 years of age to use our Platform and services. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
4. Changes to the Terms
We reserve the right to update or modify these Terms at any time at our sole discretion. All changes are effective immediately when posted and apply to all access to and use of the Platform thereafter. We will notify you of material changes through the Platform or via email. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of the changes.
5. Account Registration and Security
5.1 Account Creation
To access certain features of the Platform, including subscription services, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Immediately notify us of any unauthorized access to your account
5.2 Account Responsibility
You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.
6. Subscription Services
6.1 Automatic Renewal
By subscribing to our services, you acknowledge and agree that your subscription will automatically renew at the end of each billing cycle (monthly or annually as selected) unless you cancel before the renewal date. You authorize us to charge your payment method for the renewal fee.
6.2 Subscription Fees
Subscription fees are stated at the time of purchase and may be subject to change. We will notify you of any fee changes in advance, and such changes will take effect at the start of your next billing cycle after notice is provided.
7. Payment Terms and Non-Refundable Policy
7.1 Payment Authorization
By providing payment information, you authorize us to charge your designated payment method for all fees incurred through your account, including subscription fees, applicable taxes, and any other charges.
7.2 Digital Content and Immediate Access
IMPORTANT: Our services constitute digital content that is delivered electronically and made immediately available to you upon subscription or purchase. By subscribing or purchasing, you explicitly request and consent to:
- Immediate access to and performance of our digital services;
- The commencement of service delivery before the expiration of any statutory withdrawal period; and
- The waiver of your right of withdrawal as provided under Article 16(m) of EU Directive 2011/83/EU and Portuguese Law n.º 24/2014, Article 17(1)(m).
7.3 Non-Refundable Payments
ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE, including but not limited to:
- Initial subscription charges
- Recurring subscription renewal charges
- One-time purchases of reports or assessments
- Upgraded subscription tiers
This non-refundable policy applies regardless of usage of the service after payment, satisfaction with the service, change of mind, failure to cancel before renewal, technical difficulties on your end, or inability to use the services.
7.4 Legal Basis for Non-Refundable Policy
Our non-refundable policy is legally supported under Portuguese and EU Law. According to Article 16(m) of EU Consumer Rights Directive (2011/83/EU), transposed into Portuguese law through Lei n.º 24/2014, Article 17(1)(m), consumers do not have the right of withdrawal for "the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and acknowledgment that the consumer will thereby lose the right of withdrawal."
By accepting these Terms and subscribing to our services, you provide your express consent to immediate performance and acknowledge that you lose your right of withdrawal once you access the digital content.
7.5 Billing Errors
If you believe you have been incorrectly charged, please contact us at hello@ayurvedanest.org within 30 days of the charge. We will investigate legitimate billing errors and issue appropriate corrections.
8. Cancellation of Subscription
8.1 How to Cancel
You may cancel your subscription at any time through your account settings or by contacting us at hello@ayurvedanest.org. Cancellation will take effect at the end of your current billing period.
8.2 Effect of Cancellation
Upon cancellation:
- You will retain access to subscription services until the end of your current paid period
- No refund will be issued for the remaining portion of your current billing cycle
- No further charges will be made to your payment method
- You may lose access to premium features and content
8.3 No Partial Refunds
Cancellation of a subscription does not entitle you to a refund or credit for any unused portion of your subscription period.
9. Intellectual Property Rights
9.1 Ownership
The Platform and its entire contents, features, and functionality, including but not limited to all chart calculations, reports, predictions, text, graphics, logos, icons, images, software, and the design, selection, and arrangement thereof, are owned by VedicMap / AyurvedaNest, our licensors, or other providers of such material and are protected by Portuguese, European, and international copyright, trademark, patent, trade secret, and other intellectual property laws.
9.2 Limited License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform for your personal, non-commercial use only.
9.3 Restrictions
You may not reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any content from the Platform. You may not use any automated system to access or collect data from the Platform, or attempt to decompile, reverse engineer, or discover source code in the Platform.
10. Astrological Disclaimers
10.1 For Informational Purposes Only
THE INFORMATION, CHARTS, PREDICTIONS, AND RECOMMENDATIONS PROVIDED THROUGH THE PLATFORM ARE FOR EDUCATIONAL AND ENTERTAINMENT PURPOSES ONLY AND ARE NOT INTENDED AS PROFESSIONAL ADVICE OF ANY KIND, INCLUDING BUT NOT LIMITED TO MEDICAL, FINANCIAL, LEGAL, OR PSYCHOLOGICAL ADVICE.
10.2 No Guarantees
Vedic astrology is an ancient system of knowledge. While we strive for accuracy in our calculations, we make no guarantees regarding the accuracy, completeness, or applicability of any astrological prediction, interpretation, or remedy provided through our Platform. You should always use your own judgment and consult qualified professionals before making important life decisions.
10.3 Remedies Disclaimer
Astrological remedies (mantras, gemstones, fasting, etc.) provided through our Platform are based on traditional Vedic astrological principles. They are not medical treatments and should not replace professional healthcare advice. Always consult a qualified healthcare provider before making health-related changes.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VEDICMAP, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Platform
- Any conduct or content of any third party on the Platform
- Any content obtained from the Platform
- Any actions taken or decisions made based on astrological information provided
- Unauthorized access, use, or alteration of your transmissions or content
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Portugal. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Portugal. For EU consumers, this does not affect your right to bring proceedings in your country of residence as provided by applicable EU regulations.
